The Lord Chancellor, Liz Truss, has a specific duty to uphold and defend the independence of the judiciary. It was widely felt that she did not fulfil this duty adequately when three High Court judges came under ferocious attack in parts of the press after their controversial ruling in early November that parliamentary approval would be needed before Article 50 of the Lisbon Treaty could be invoked to begin the process of withdrawal from the European Union. Alistair Lexden raised this serious issue in an oral question in the Lords on November 15.
